The Physical Reality Check

Reliability of Evidence refers to the credibility and accuracy of the information presented in court. Evidence is not reliable if it contradicts the fundamental laws of human physiology or physics.

The Case Insight: In criminal proceedings, a person’s physical and mental state at the exact moment of an incident is a critical factor. If an individual is abruptly awakened from sleep (a semi-conscious state), their motor skills are impaired, and their capacity for initiated aggression is biologically limited.

The Anomaly: When a court classifies a situation as a “mutual fight” (pahoinpitely/nujakka) without accounting for the fact that one party was asleep seconds before, the reliability of the evidence is compromised. A “mirage of aggression” is created where the court substitutes the actual sequence of events with a simplified narrative. To ignore the transition from sleep to defense is to ignore the truth.
