The Victim-to-Defendant Flip: A Breach of Article 6 ECHR

In the Finnish legal system, the pursuit of statistical outcomes often overrides the foundational Rule of Law. We are currently documenting a systemic failure in the proceedings against an individual in Case R 706/2025/5226, which has migrated to the appellate level following a deeply compromised process in the Helsinki District Court (Helsingin käräjäoikeus).

The Procedural Manipulation

The initial proceedings, presided over by Judge Inga-Liisa Paavola and Prosecutor Tomas Niemitalo, were marked by a fundamental breach of the Pre-trial Investigation Act and Article 6 of the ECHR. Authorities engaged in deceptive procedural conduct by surreptitiously changing the individual’s status from Victim (Asianomistaja) to Suspect during a telephone “interrogation.”

• Violation of the Presumption of Innocence: The individual remained unaware of this status transformation for an entire year, effectively stripping them of the right to counsel and the right to silence.
• Physical Impossibility: Authorities coerced statements during a mobile call amidst extreme ambient noise and intermittent connectivity. The physical impossibility of conducting a formal interrogation under these conditions renders the reliability of evidence void.
• The Manufactured Narrative: Despite the physical impossibility of the alleged act—demonstrable via photographic evidence—the prosecution continues to ignore the required standard of proof to maintain a fabricated case.

Our Analysis

Under the principle of IN DUBIO PRO REO, any evidence derived from this unlawful, deceptive mobile “interrogation” must be excluded. The investigation is fundamentally corrupt, prioritizing a manufactured narrative over the state’s duty to protect human rights.
